SECTION 18 Notice Per The Protection Of Personal Information Act 4 Of 2013 (POPIA)

HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd), Registered Address: 57 Underwood Road Pinetown, KwaZulu Natal, 3601, CIPC Reg. Number: 2017/122922/07, is required to process the personal information of various data subjects, which include but are not exclusive to the following:

  • Data subjects who have appointed HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) to provide services in terms of which HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) markets and sells temporary accommodation within a building that is owned by a third party property owner;

  • Data subjects who utilize the various platforms of HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) to procure temporary accommodation within a building that is owned by a third party property owner;

  • Data subjects who may submit applications for employment;

  • Third parties who provide services to HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd);

  • Third parties who provide services on behalf of HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd); etc.;

for various reasons which may include but are not exclusive to the following:

  • to facilitate the process of authorising and allowing the data subjects access to the various premises of HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd);

  • for the purpose of appointing HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) to provide services in terms of which HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) markets and sells temporary accommodation within a building that is owned by a third party property owner;

  • for the purpose of allowing data subjects to access the various platforms of HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) to procure temporary accommodation within a building that is owned by a third party property owner

  • the provision of information to data subjects through the operation of applicable legislation by to provide services in terms of which HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) markets and sells temporary accommodation within a building that is owned by a third party property owner;

  • for statistical purposes;

  • for communication and/or information purposes;

  • as a good governance practice;

  • The vetting of educational and/or employment and/or credit and/or criminal (if applicable) history; etc.


The types of information that may be processed may include but are not exclusive to the following:


  • Name and surname / registered name of the juristic entity (which ever may be applicable);

  • Maiden name (if applicable);

  • Mailing address

  • Contact details;

  • Image;

  • Identity number;

  • Trading name;

  • VAT registration number;

  • Business registration number;

  • Website details;

  • Certification of CIPRO registration and ownership;

  • VAT certificate;

  • Current valid VAT tax clearance certificate;

  • Tax Clearance certificate;

  • Letter of verification of bank details with grading;

  • Current BBBEE rating certificate issued by an accredited rating agency or letter from an account (as required);

  • Ownership information;

  • Executive management and board members’ information;

  • “Authority for signatory” information;

  • Information pertaining to acts of insolvency and/or business rescue;

  • Referee details;

  • Key personnel details.

The afore-mentioned information must be provided by the data subject and/or the person with the relevant authority to do so on behalf of the data subject.

The provision of the afore-mentioned information is a mandatory requirement per POPIA to fulfil obligations (which may include contractual obligations) as stipulated per the various reasons per which HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) may process the personal information of data subjects.

The failure to provide the afore-mentioned information and/or an objection to use the information may result in HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) not being able to engage with the data subject as stipulated per the various reasons per which HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) may process the personal information of data subjects, as the afore-mentioned information is required for the legitimate reasons as mentioned in this document.

The relevant personal information provided may also be utilised by HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) for marketing and/or communication purposes and may be shared with the parent company of HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) as well as with any subsidiaries of said parent company and/or any subsidiaries of HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd). To object to receiving the afore-mentioned marketing communications and/or the sharing of your personal information, as mentioned above, please send an email to hello@HOMii.co.za.

HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) is required to adhere to various laws which include, but are not exclusive to the following:

  • Companies Act 71 of 2008

  • Income Tax Act 58 of 1962

  • The Unemployment Insurance Act 30 of 1966

  • Income Tax Act 95 of 1967

  • Value Added Tax Act 89 of 1991

  • Occupational Health and Safety Act 85 of 1993

  • Compensation for Occupational Injuries and Diseases Act 130 of 1993

  • Labour Relations Act 66 of 1995

  • Basic Conditions of Employment Act 75 of 1997

  • The Employment Equity Act 55 of 1998

  • The Skills and Development Act 97 of 1998

  • Promotion of Access of Information Act 2 of 2000

  • Electronic Communications and Transactions Act 25 of 2002

  • The Protection of Personal Information Act 4 of 2013

  • Consumer Protection Act, No. 68 of 2008

  • Unemployment Insurance Contributions Act, No. 4 of 2002

  • Broad-based Black Economic Empowerment Act 53 of 2003,

and may retain the personal information provided herein per applicable legislative requirements, and/or per guidance of the relevant authority for the regulation of the business of HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd), and/or as a good governance practice, and/or to retain the information for record keeping and/or statistical purposes.

HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) will endeavour to ensure that the personal information provided by the data subject will be afforded safety measures for the protection of the afore-mentioned information in both the soft copy and hard copy formats in mitigation of any security breaches, actual or threatened.

Should HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd), be required to furnish the personal information as provided herein, via cross border transfer, HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) undertakes to ensure that the recipient of the information (unless the information is provided to the data subject themselves or to the person acting on behalf of the data subject) will be bound to adhere to the requirements of POPIA via an agreement which will contain the safety measures as required by the afore-mentioned legislation.

Recipients of personal information may include various persons authorised by HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) to access such information and/or structures and/or Offices as may be identified per the organisational structure of HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) as well as to parties who may be entitled to receive such information per any applicable legislation.

Should the information provided by the data subject, be required for research purposes, HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) will endeavour to ensure that same is fully anonymised and de-identified.

Data subjects may access and amend their information, inclusive of personal information by sending an email to popia@mmglaw.co.za.

Please note that the data subject remains solely responsible for ensuring that the information provided by the data subject is correct and up to date at all times.

Note further that, where applicable, should the data subject require the release of information, inclusive of personal information, by HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd), to the data subject per the operation of applicable legislation, the data subject undertakes to ensure that all of the requirements of POPIA will be met with regard to such personal information.

The continuation and completion of the process by which the data subject furnishes the information, inclusive of personal information to HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd), is considered as the data subject’s specific and informed expression of will as required by the Protection of Personal Information Act 4 of 2013.

Please note further that any and all information that the data subject may encounter and/or be provided with, as part of their engagement with HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd), may be deemed as confidential and may only be disseminated upon the instruction of the Information Officer and/or Deputy Information Officer of HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) or upon the operation of law. Should the dissemination of information be required in the latter instance, the Information Officer and/or Deputy Information Officer of HOMii Lifestyle (PTY) Ltd (a subsidiary of Urban Lifestyle Investment Holdings (PTY) Ltd) must be informed of the intention to disseminate prior to the dissemination taking place.  Note that this requirement of confidentiality shall operate in perpetuity.

A breach of the terms outlined in this document may result in remedies per applicable laws, being sought.
