Please read these Terms of Service (“Terms”) carefully as they contain important information about your legal rights, remedies and obligations. By accessing or using the HOMii Platforms, you agree to comply with and be bound by these Terms.

Please note: By accepting these Terms, you agree to be bound by this arbitration clause and class action waiver. Please read it carefully.

General

  1. Applications for temporary accommodation may only be made via the HOMii Application (‘the App’) which can be downloaded from the Google Play Store or the Apple App Store, or via the HOMii website (www.homii.co.za).

  2. All bookings at HOMii are subject to the terms and conditions contained herein. You acknowledge and agree that you have read, understood, and will abide by same.

  3. You acknowledge and agree to use this property solely for the purpose of temporary accommodation.

  4. This a not a lease agreement between the parties and does not create any rights of tenant and landlord as contemplated in the Rental Housing Act.

  5. This is a contract of temporary accommodation which is paid in advance for the required stay.

  6. You are provided with access which shall expire at 12:00 on the 1st of the next month irrespective of the date on which the you commenced your stay at HOMii. Should the period be less than one calendar month then you will be charged for this period on a pro rata basis.

  7. Any request for a renewal shall be subject to the application of all the terms and conditions contained herein and more specifically Clause 7 below.

  8. You agree and acknowledge that your stay is only valid for the period of the pre-payment.

  9. You agree that you have no right to occupy the space if the period for which the space was pre-paid has expired.

  10. Right of admission is always reserved.

  11. You acknowledge that HOMii has the right in its sole discretion to refuse entry to anyone whether or not you have pre-paid for that particular premises. has pre-paid for that particular premises.

  12. Exclusions shall be based on, but not limited to the prohibitive conditions listed hereunder in Clause 10 below.

1. Booking Accommondation

You understand that a confirmed booking of temporary accommodation is a limited license granted to you by HOMii to enter, occupy and use the accommodation for the duration of your stay, during which time HOMii (only where and to the extent permitted by applicable law) retains the right to re-enter the accommodation, in accordance with your agreement by HOMii.

You agree to leave the accommodation no later than the checkout time specified herein or such other time as mutually agreed upon between you and HOMii. If you stay past the agreed upon checkout time without HOMii's consent (“Overstay”), you no longer have the right to stay in the accommodation and HOMii is entitled to make you leave in a manner consistent with applicable laws. In addition, you agree to pay the listed fee for the next month to cover the inconvenience suffered by HOMii, plus all applicable legal expenses incurred by HOMii to make you leave (collectively, “Overstay Fees”). If you Overstay at an accommodation, you authorize HOMii to deduct any balances that you may have in your Homii Wallet. Any monies held by HOMii, if required by HOMii, may be applied to any Overstay Fees due for your overstay.

2. Eligibility, using the HOMii Platforms, Guest Verification

In order to register a HOMii Account you must be an individual at least 18 years old or a duly organized, validly existing business, organization or other legal entity in good standing under the laws of the country you are established and able to enter into legally binding contracts.

User verification on the Internet is difficult. Notwithstanding the above, for transparency and fraud prevention purposes, and as permitted by applicable laws, HOMii:

  • ask guests to provide a form of government identification or other information or undertake additional checks designed to help verify the identities or backgrounds of guests,

  • screen guests against third party databases or other sources and request reports from service providers, and

  • where we have sufficient information to identify a guest, obtain reports from public records of criminal convictions or sex offender registrations or an equivalent version of background or registered sex offender checks in your local jurisdiction (if available).

If you access or download the Application from the Apple App Store or the Google Play Store, you agree to Apple’s Licensed Application End User License Agreement or Google’s Play terms of service . 3. Account Registration

You must register an account (“HOMii Account”) to access and use certain features of the HOMii Platform. If you are registering an HOMii Account for a business, organization or other legal entity, you represent and warrant that you have the authority to legally bind that entity and grant us all permissions and licenses provided in these Terms.

  • You must provide accurate, current and complete information during the registration process and keep your HOMii Account and public HOMii Account profile page information up to date at all times.

  • You may not register more than one (1) HOMii Account unless HOMii authorizes you to do so.

  • You are responsible for maintaining the confidentiality and security of your HOMii Account credentials and may not disclose your credentials to any third party. You must immediately notify HOMii if you know or have any reason to suspect that your credentials have been lost, stolen, misappropriated, or otherwise compromised or in case of any actual or suspected unauthorized use of your HOMii Account. You are liable for any and all activities conducted through your HOMii Account, unless such activities are not authorized by you and you are not otherwise negligent (such as failing to report the unauthorized use or loss of your credentials).

  • HOMii may enable features that allow you to authorize other Guests or certain third parties to take certain actions that affect your HOMii Account. For example, we may enable Guests to link their HOMii Accounts to other Guests with the intention to add other Guests as sharers. These features do not require that you share your credentials with any other person. No third party is authorized by HOMii to ask for your credentials, and you shall not request the credentials of another Guest.

If you access or download the Application from the Apple App Store or the Google Play Store, you agree to Apple’s Licensed Application End User License Agreement or Google’s Play terms of service . Some areas of the HOMii Platform implement Google Maps/Earth mapping services, including Google Maps API(s). Your use of Google Maps/Earth is subject to the Google Maps/Google Earth Additional Terms of Service.

4. Facilities

There are various types of accommodation models available for pre-paid accommodation including, but not limited to:

  • HOMii Daily/Short Stay Apartments

  • HOMii Co-Living model

  • HOMii Bachelor Apartments

  • HOMii Loft Apartments

  • HOMii One-Bedroom Apartments

  • HOMii Two-Bedroom Apartments

On first occupancy, water and electricity meters are provided with a minimum amount of credit for usage. Thereafter you will be responsible for topping up their credit. No refunds are available for credit not utilised.

Facilities include, but not limited to:

  • 24 hours access controlled.s

  • Access to certain areas of HOMii premises may be restricted.

  • Where parking available to you, HOMii shall not be liable for any damage theft and or loss to your vehicles and/or property. You accordingly indemnify HOMii for such damage, theft or loss.

  • In Unfurnished/Partly Furnished apartments, HOMii only provides the aerial connections for TV and Decoder Units. You are required to provide your own TV and Decoder Units for your personal use.

  • You are required to hold your own TV licences and other subscriptions.

  • In Fully Furnished Apartments HOMii provides a TV only.

  • HOMii provides temporary accommodation and as such the room allocated to you may not be used as an address for primary residence.

  • You are provided with laundry facilities on the premises. Laundry machines charges are for the account of the Guest. These amounts are separate from accommodation charges.

5. Payments

All Payments must be made in advance and is a prerequisite to secure your booking.

You will only be allowed to pay for a maximum period of a calendar month after which you must renew your application and make the requisite payment for the succeeding month. You must follow the same procedure for each subsequent month you intend to remain in the accommodation. Bookings are for a maximum period of 1 (one) calendar month.

Payments can only be made via the HOMii App or the HOMii Website. HOMii buildings have self-service kiosks located in the reception areas which caters for a you to log into your account to renew if you are unable to do so on your mobile device

For a new building / floor release, a deposit amount stipulated against that listing will be required to be paid to secure your desired room type. The balance of the total amount due is payable by the 25th of the month preceding your occupation date, failing which HOMii does not guarantee admission into your selected room type of choice.

6. Refunds/Cancellations

You may only cancel your booking for accommodation for the month and shall be exonerated from any liability of the charges (excluding administration fees for which you remain liable and which HOMii will be entitled to levy) provided that HOMii is notified of the cancellation (7) days prior to the commencement of the stay.

Should you wish to cancel you booking and such cancellation is less than the period mentioned above then you are liable to pay HOMii a cancellation fee, which is agreed to be 20% of the amount charged and which the you agree to be reasonable by his acceptance of these terms and conditions.

Refunds will be executed within a maximum period of 21 days.

For a new building / floor releases where a deposit has been paid to secure a listing, and you cancel your booking, you forfeit your booking deposit and which the you agree to be reasonable by his acceptance of these terms and conditions.

7. Renewals

Renewals open on the 15th of every month allowing you to renew your stay for the coming month.

For Guests wishing to renew their stay, s/he must do so at the latest by close of business on the last day of the month. Failure to do so, HOMii cannot guarantee that you will be allocated to the same room you had occupied in the preceding month.

Such renewals will operate on a month to month basis and the Guest is required to renew the application for accommodation at the end of each succeeding month should s/he wish to continue their stay.

In the event that the Guest fails to renew your stay, access to both the room and building will be revoked, and subsequently your belongings shall be placed in storage. Refer to Clause 13 below for storage charges and limitation of damages.

8. Booking Modifications, Cancellations and Refunds, Resolution Centre

You can cancel a confirmed booking at any time pursuant to the cancellation policy herein set by the HOMii, and HOMii will refund the amount of the Total Fees due to you in accordance with such cancellation policy.

9. Damage to Accommodations, disputes between Guests

As a HOMii Guest, you are responsible for leaving the Accommodation (including any personal or other property located at the Accommodation) in the condition it was in when you arrived. You are responsible for your own acts and omissions and are also responsible for the acts and omissions of any individuals whom you invite to, or otherwise provide access to, the Accommodation, excluding the HOMii (and the individuals the HOMii invites to the Accommodation, if applicable).

10. Prohibitive Conditions

  1. You are not allowed to be found drunk on the premises.

  2. You shall not be under the influence of any narcotic or narcotic substance unless s/he is in possession of a valid prescription.

  3. You are not allowed to wash any clothes on the premises (unless in the designated laundry area) or hang any clothes outside the window/balcony, the common areas and/or the building.

  4. HOMii does not accept any responsibility for damage to person or property. The You hereby indemnifies HOMii of such claim whatsoever and howsoever it desires.

  5. You agree to use the property and the HOMii platforms solely for the purpose of temporary accommodation as per the maximum occupancy allowed per room and agree not to and will not assist or enable others to:

    • use the property for any improper, illegal, or immoral purposes;

    • rent and/or charge fees for the use of the property to third parties;

    • cause (nor allow any Guest or visitors to cause) any nuisance, annoyance or disturbance to neighbours, other Guests and/or to the owner and/or the owners agents

    • smoke or allow smoking on the property except in those areas designated for smoking;

    • keep pets on the property;

    • breach or circumvent any applicable laws or regulations, agreements with third-parties, third-party rights, or our Terms and Conditions;

    • copy, store or otherwise access or use any information, including personally identifiable information about any other Guest, contained on the HOMii Platform in any way that is inconsistent with HOMii’s Privacy Policy or these Terms or that otherwise violates the privacy rights of Guests or third parties;

    • book any Listing with intent to sublet to a third party;

    • discriminate against or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation, or otherwise engage in any violent, harmful, abusive or disruptive behaviour;

    • use, display, mirror or frame the HOMii Platform, or any individual element within the HOMii Platform, HOMii's name, any HOMii trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page in the HOMii Platform, without HOMii's express written consent;

    • dilute, tarnish or otherwise harm the HOMii brand in any way, registering and/or using HOMii or derivative terms in domain names, trade names, trademarks or other source identifiers, or registering and/or using domains names, trade names, trademarks or other source identifiers that closely imitate or are confusingly similar to HOMii domains, trademarks, taglines or promotional campaigns;

    • use any robots, spider, crawler, scraper or other automated means or processes to access, collect data or other content from or otherwise interact with the HOMii Platform for any purpose;

    • avoid, bypass, remove, deactivate, impair, descramble, or otherwise attempt to circumvent any technological measure implemented by HOMii or any of HOMii's providers or any other third party to protect the HOMii Platform;

    • attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the HOMii Platform;

    • take any action that damages or adversely affects, or could damage or adversely affect the performance or proper functioning of the HOMii Platform;

    • from performing acts and/or bringing onto the premises any item that is likely to cause a fire hazard;

    • from the use of open candles, flames or primus stoves on the premises;

    • carry firearms or ammunition onto the premises.

  6. You shall acquaint yourselves with evacuation procedures.

  7. The number of Guests allowed per room must not exceed:

    • 2 Guests per Bachelor apartment

    • 3 Guest per One-Bedroom Apartment

    • 4 / 5 Guest per Two-Bedroom Apartments

  8. You shall be solely responsible for any damages, breakages, theft and loss to the property or any part of it during his/her/their stay. The owner/management/operator may recover the costs from you for any necessary repair and/or replacement

  9. You shall familiarise yourselves with the terms and conditions provided for on the HOMii website and HOMii App and abide by the information. The terms and conditions are subject to change and you are required to continue to familiarise themselves with same on an ongoing basis.

  10. You are solely responsible for compliance with any and all laws, rules, regulations, and Tax obligations that may apply to your use of the HOMii Platform.

  11. You acknowledge that HOMii has no obligation to monitor the access to or use of the HOMii Platform by any Guest or to review or disable access to, but has the right to do so to (i) operate, secure and improve the HOMii Platform (including without limitation for fraud prevention, risk assessment, investigation and customer support purposes); (ii) ensure Guests’ compliance with these Terms; (iii) comply with applicable law or the order or requirement of a court, law enforcement or other administrative agency or governmental body; (iv) respond to Guest Content that it determines is harmful or objectionable; or (v) as otherwise set forth in these Terms. Guests agree to cooperate with and assist HOMii in good faith, and to provide HOMii with such information and take such actions as may be reasonably requested by HOMii with respect to any investigation undertaken by HOMii or a representative of HOMii regarding the use or abuse of the HOMii Platform.

  12. If you feel that any Guest you interact with, whether online or in person, is acting or has acted inappropriately, including but not limited to anyone who (i) engages in offensive, violent or sexually inappropriate behaviour, (ii) you suspect of stealing from you, or (iii) engages in any other disturbing conduct, you should immediately report such person to the appropriate authorities and then to HOMii by contacting us with your police station and report number (if available). You agree that any report you make will not obligate us to take any action (beyond that required by law, if any).

11. Term and Termination, Suspension and Other Measures

HOMii may immediately, without notice, terminate this Agreement and/or stop providing access to the HOMii Platform if (i) you have materially breached your obligations under these Terms, (ii) you have violated applicable laws, regulations or third party rights, or (iii) HOMii believes in good faith that such action is reasonably necessary to protect the personal safety or property of HOMii, its Guests, or third parties (for example in the case of fraudulent behaviour of a Guest).

In addition, HOMii may take any of the following measures (i) to comply with applicable law, or the order or request of a court, law enforcement or other administrative agency or governmental body, or if (ii) you have breached these Terms, applicable laws, regulations, or third party rights, (iii) you have provided inaccurate, fraudulent, outdated or incomplete information during the HOMii Account registration, Listing process or thereafter, (iv) you and/or your Listings or HOMii Services at any time fail to meet any applicable quality or eligibility criteria, (v) HOMii otherwise becomes aware of or has received complaints about your performance or conduct, (vi) you have repeatedly cancelled confirmed bookings or failed to respond to booking requests without a valid reason, or (vii) HOMii believes in good faith that such action is reasonably necessary to protect the personal safety or property of HOMii, its Guests, or third parties, or to prevent fraud or other illegal activity:

  • cancel any pending or confirmed bookings;

  • limit your access to or use of the HOMii Platform;

  • temporarily or permanently revoke any special status associated with your HOMii Account;

  • temporarily or in case of severe or repeated offenses permanently suspend your HOMii Account and stop providing access to the HOMii Platform.

In case of non-material breaches and where appropriate, you will be given notice of any intended measure by HOMii and an opportunity to resolve the issue to HOMii's reasonable satisfaction.

12. Content

You will not use, copy, adapt, modify, prepare derivative works of, distribute, license, sell, transfer, publicly display, publicly perform, transmit, broadcast or otherwise exploit the HOMii Platform, except to the extent you are the legal owner of certain Guest Content or as expressly permitted in these Terms. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by HOMii or its licensors, except for the licenses and rights expressly granted in these Terms.

Subject to your compliance with these Terms, HOMii grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to download and use the Application on your personal device solely for your personal and non-commercial use.

13. Miscellaneous

  • HOMii will not be held liable for any goods which are left behind by the Guest.

  • Should a Guest not renew their application and their personal belongings remain in the apartment, HOMii will have the right to remove these goods and place them in storage at the rate of R200.00 per day. The Guest will be held liable for the storage costs and goods will only be released on full payment of the costs. Should the Guest fail to recover their belongings within 14 days, HOMii will have the right to sell the property to mitigate its damages. Homii takes no responsibility for any missing or damaged items that have been moved into storage.

  • If the Guest is asked to vacate the premises by HOMii management refunds may be awarded at the sole discretion of HOMii management.

  • Check out is before 10h00 on the date of expiry of the prepaid period which is the 1st (first) of every month. Should the You check out later than the stipulated time s/he will be charged for the day and/or any further period at the applicable tariff.

  • Check in commences from 14h00 and is dependent on the accessibility/availability of the room

  • Visitors (No charge) - Visitor/s are allowed to enter the premises by no later than 21h00, and are required to leave the premises by 23h00. In the event of a visitor breaching the time regulation, the main guest will remain liable for an infringement fee. Visitor(s) are required to download the HOMii app and onboard themselves by uploading a copy of their identity document and selfie to gain access to the property. The number of visitors together with the guest/s must not exceed the total number allowed per unit as stated below:

    • Shared Room in Co Living/Communal Space – guest and visitor may not exceed 2 persons

    • Private Room in Co Living/Communal Space – guest(s) and visitor(s) may not exceed 4 persons

    • Bachelor Apartment – guest(s) and visitor(s) may not exceed 4 persons

    • One Bedroom Apartment – guest(s) and visitor(s) may not exceed 6 persons

    • Two bedroom apartment – guest(s) and visitor(s) may not exceed 8 persons

  • Sleep Over - Guest are allowed six (6) sleepover events per month at no charge, thereafter an applicable charge per event will be applied. Sleepovers are required to vacate the premises by 10h00 the next day. The guest will be charged at the applicable tariff per person per night for sleepovers who stay beyond these hours. Sleepover/s are required to produce valid identification at reception to gain access into the property. The total occupants to sleepover over together with the guests cannot exceed the maximum number of persons allocated for total occupancy of that particular unit:

    • Shared Room in Co Living/Communal Space - No sleepovers allowed

    • Private Room in Co Living/Communal Space – guest(s) and sleepover(s) may not exceed 2 persons

    • Bachelor Apartment – guest(s) and sleepover(s) may not exceed 2 persons

    • One Bedroom Apartment – guest(s) and sleepover(s) may not exceed 3 persons

    • Two Bedroom Apartment – guest(s) and sleepover(s) may not exceed 4 persons

  • Children under the age of 16 are to be supervised by adults/ parents at all times exceed the total number of allowed per unit.

  • HOMii shall endeavour to renew your stay in the same room but reserves its right to change your room.

  • You are advised that you can bring certain personal belongings onto the premises, but this shall not create a lease between the parties.

  • The person/people occupying the room fully understand that he/she/they occupy the room as a guest, and not a resident or lodger.

  • HOMii reserves the right to restrict access of guest to certain floors or units. You are prohibited from requesting access to any part or portions of the restricted areas of the premises.

14. Modifications of these terms

HOMii reserves the right to modify these Terms at any time in accordance with this provision. If we make changes to these Terms, we will post the revised Terms on the HOMii Platforms.

15. Disclaimers

If you choose to use the HOMii Platform, you do so voluntarily and at your sole risk. The HOMii Platform and is provided “as is”, without warranty of any kind, either express or implied.

If we choose to conduct identity verification or background checks on any Guest, to the extent permitted by applicable law, we disclaim warranties of any kind, either express or implied, that such checks will identify prior misconduct by a Guest or guarantee that a Guest will not engage in misconduct in the future.

You agree that some Experiences, Events, other HOMii Services may carry inherent risk, and by participating in such services, you choose to assume those risks voluntarily. For example, some HOMii Services may carry risk of illness, bodily injury, disability, or death, and you freely and wilfully assume those risks by choosing to participate in those HOMii Services. You assume full responsibility for the choices you make before, during and after your participation in a HOMii Service. If you are bringing a minor as an additional You, you are solely responsible for the supervision of that minor throughout the duration of your HOMii Service and to the maximum extent permitted by law, you agree to release and hold harmless HOMii from all liabilities and claims that arise in any way from any injury, death, loss or harm that occurs to that minor during the HOMii Service or in any way related to your HOMii Service.

The foregoing disclaimers apply to the maximum extent permitted by law. You may have other statutory rights. However, the duration of statutorily required warranties, if any, shall be limited to the maximum extent permitted by law.

16. Liability

You acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of your access to and use of the HOMii Platform , your stay at any Accommodation, participation in any Experience or Event or use of any other HOMii Service or any other interaction you have with other Guests whether in person or online remains with you. Neither HOMii nor any other party involved in creating, producing, or delivering the HOMii Platform or will be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with

  1. these Terms,

  2. from the use of or inability to use the HOMii Platform,

  3. from any communications, interactions or meetings with other Guests or other persons with whom you communicate, interact or meet with as a result of your use of the HOMii Platform, product liability or any other legal theory, and whether or not HOMii has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose. In no event will HOMii’s aggregate liability arising out of or in connection with these Terms and your use of the HOMii Platform including, but not limited to from the use of or inability to use the HOMii Platform and in connection with any Accommodation, Experiences, Events or other HOMii Service, or interactions with any other Guests, exceed the amounts you have paid or owe for bookings via the HOMii Platform as a you in the twelve (12) month period prior to the event giving rise to the liability, or if you are a HOMii, the amounts paid by HOMii to you in the twelve (12) month period prior to the event giving rise to the liability, or one thousand Rands (R1000), if no such payments have been made, as applicable. The limitations of damages set forth above are fundamental elements of the basis of the bargain between HOMii and you. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

17. Indemnification

To the maximum extent permitted by applicable law, you agree to release, defend (at HOMii’s option), indemnify, and hold HOMii and its affiliates and subsidiaries, including but not limited to, HOMii platforms, HOMii officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with

  1. your breach of these Terms,

  2. your improper use of the HOMii Platforms or any HOMii Services,

  3. your interaction with any Guest, stay at an Accommodation, participation in an Experience, Event or other HOMii Service, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, stay, participation or use,

  4. HOMii’s Collection and Remittance of Occupancy Taxes, or

  5. your breach of any laws, regulations or third-party rights.

18. Feedback

We welcome and encourage you to provide feedback, comments and suggestions for improvements to the HOMii Platform. You may submit Feedback by emailing us, through the “Contact” section of the HOMii Platform, or by other means of communication. Any Feedback you submit to us will be considered non-confidential and non-proprietary to you. By submitting Feedback to us, you grant us a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use and publish those ideas and materials for any purpose, without compensation to you.

19. General Provisions

If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck and will not affect the validity and enforceability of the remaining provisions.

HOMii’s failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise permitted under law.

You may not assign, transfer or delegate this Agreement and your rights and obligations hereunder without HOMii's prior written consent. HOMii may without restriction assign, transfer or delegate this Agreement and any rights and obligations hereunder, at its sole discretion, with 7 days prior notice. Your right to terminate this Agreement at any time remains unaffected.
